Wage and Hour Lawsuits Jump 13%

"According to data collected from PACER's Case Locator service operated by the Administrative Office of U.S. Courts, the number of FLSA related cases filed in federal district courts nationwide rose from 5,210 in 2008 to 6,118 in 2009....That number reflects a 13% increase in FLSA cse filings over the same period in 2009." Fourth Circuit Joins Four Prior Circuits in Ratifying Half Time Calculation of Overtime Damages Due Misclassified Exempt Employee

"It is well understood that employees misclassified as exempt under the FLSA are entitled to overtime pay for hours worked in excess of forty in a week. However, while the United States Department of Labor takes the position that any unpaid overtime is calculated using the “half-time” method, not all of the Circuit Courts have confirmed the appropriateness of such calculation. Last week, the Court of Appeals for the Fourth Circuit (which covers Maryland, Virginia, West Virginia, North and South Carolina), joining the First, Fifth, Seventh and Tenth Circuit courts, held that such calculation is appropriate." DOL Actively Pursues, FLSA Claims on the Rise

"...The DOL has been actively pursuing claims of FLSA violations. According to the DOL, in fiscal year 2008, more than 197,000 employees received a total of $140.2 million in minimum wage and overtime back wages because of FLSA violations. Most of that – $123 million – was due to overtime violations. The Wage and Hour Division at DOL also fined employers $3.1 million in penalties for FLSA violations in 2008.Along with DOL actions, more employees are filing lawsuits against their employers claiming they were not paid what they were owed. According to some reports, the number of FLSA lawsuits filed in federal courts in the second quarter of 2010 grew 22 percent over the first quarter of 2010.As the New Year begins, employers should take the time to review their overtime policies to ensure full compliance with FLSA. Anything short of full compliance places employers at risk of lawsuits and fines." Read More
